Sports Portraits Photography Agreement

This agreement is put into place with Life in Portraits to ensure the expectations have been communicated.  Please read and submit a completed contract.  If you have any questions, please contact Sara to discuss before your portrait session.

Studio Policies

Delivery

Please allow up to 2 weeks for your portraits to be edited and the gallery link delivered via email. Portrait sessions are curated in the order in which they are taken.

Payment

Due to the custom nature of the artwork and the enormous labor/proofing/editing efforts required to prepare your order for print or digital image delivery, your order must be paid in full before any art will be produced. Once the lab receives a print order or a digital order is delivered, it is deemed non-refundable. Due to the downloadable nature of digital files, there are NO RETURNS for digital products. The sale is final once you view the digital portraits and accept the files. Payments may be made in cash, Visa, MasterCard, and Amex. 

Archives

Ordered images are kept on file for one year. All other images are deleted after 30 days to clear archives for future sessions. Life in Portraits and Sara Kirkendall do not guarantee that photos will be available for reorder due to the nature of digital file storage.  You should back up your digital portrait on two separate and independent hard drives or cloud drives.  If you are unsure of how to back up your files, please do not hesitate to ask for help.

Privacy

Life in Portraits and Sara Kirkendall have the right to use and publish images and photographs taken during your photography session to promote their service further, including portfolio, website, display, advertisement, and editorial use. If you wish to keep your images private, please discuss your concerns with Sara before your session.

Copyright

Life in Portraits and Sara Kirkendall retains the copyrights to all images created during your session(s). The images provided are for any reasonable personal purposes, including but not limited to printing, copying, emailing, and web publishing. A print release will be provided with the package and image purchases for personal printing purposes. Photographs and digital images may not be scanned, copied, edited, or reproduced in any way.

Media

Life in Portraits and Sara Kirkendall will be the only photographers at any booked photo session(s). No other cameras (including cell phones) or videotaping is allowed unless requested by the Photographer. The Photographer will not continue if there are other cameras or videotaping during the session.

Image Sharing

Clients are permitted to share their purchased digital portraits on social media. These images are not to be altered. Please tag or link to Life in Portraits (@lifeinportraitsphotography) when sharing your portraits.

Damage

Life in Portraits and Sara Kirkendall are not responsible for portraits' damage after delivery to the client, including damage caused during transit by US mail. The client assumes all responsibility for the safety of all photographs upon receipt and releases Life in Portraits and Sara Kirkendall from any liability due to the loss or damage of the images.

Liability

You agree to hold Life in Portraits, Sara Kirkendall, and her employees and assistants harmless for any injury, loss, or damage to yourself, your family, and personal property during your portrait session. Sara or her assistants will ask you to stand/sit/pose, or take action in specific ways to obtain the best possible images. Life in Portraits and Sara Kirkendall retain the right to end the session at any time for conduct that endangers the Photographer or her property's safety (gear, camera, props, etc.).

Responsibility for Equipment Damage

The client agrees to be responsible for any damage caused to the property, equipment, or other assets belonging to the service provider/owner during the portrait session.

The service provider/owner will assess any damage caused and will provide the client with a written statement detailing the nature and extent of the damage, along with the estimated or actual cost of repairs or replacement.

The client agrees to pay the full cost of repairing or replacing any damaged property. Payment must be made within 30 days of receiving the written statement from the service provider/owner.
